TERMS OF SALES
ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE:
► Sales made online in the store are subject to these general conditions of sale and any order placed by the buyer implies acceptance of the content of the provisions below.
► These general conditions of sale apply exclusively to the online sale of Amélie Pomélo products on the website ameliepomelo.com
► The Site's products are sold to customers for their personal use.
These General Conditions of Sale (CGV) apply to all sales of products offered by Améliepomélo.com (hereinafter referred to as "the Seller") to its customers (hereinafter referred to as "the Customer") via its website. .
1- Product information
► In accordance with article L.111-1 of the Consumer Code, the buyer can, prior to ordering, read on the website the essential characteristics of the products he wishes to order: price, description, material as well as the shipping costs (if applicable, additional delivery costs).
► The products are offered while stocks last and are governed by these general conditions.
► The products are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, the seller cannot be held liable.
► The Améliepomélo.com site sells the following products: Stationery (printed or unique, bookmarks, posters, postcards, garlands, calendars, words to hide), stickers, table objects (mugs, vases, cups, plates, teapots, sugar bowls), paper flowers. Personalized pieces or not.
► The products sold on this site cannot be resold without the written consent of Amélie Pomélo
2- Order
► To place an order, the buyer, after having filled their virtual basket by indicating the selected products and the desired quantities, then clicks on the “order” button and provides information relating to delivery and payment method.
► Confirmation of the order entails acceptance of the General Terms and Conditions and form of contract. An email acknowledging receipt of the order and its payment is sent by the seller as soon as possible. This confirmation as well as all the computer data recorded by Amélie Pomélo are considered as proof of the transactions. It will also constitute signature and, therefore, acceptance of said transactions.
► Amélie Pomélo reserves the right to refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.
3- Price and payment terms
► The prices appearing on the site are inclusive of VAT (VAT not applicable, art 293 B of the CGI). Amélie Pomélo, in her capacity as a micro-entrepreneur, is not subject to VAT. Product prices are indicated in EUR excluding shipping costs. All orders, whatever their origin, are payable in EUR €. Amélie Pomélo reserves the right to modify its prices at any time.
► Products are invoiced on the basis of the prices in force at the time of order registration subject to availability. After completing the purchase order and before payment, the product identification will be presented to the customer, as well as the total price of the order (including shipping costs).
► The photographs taken for the site are intended to be as faithful as possible to the products sold. But the colors rendered may vary from one computer to another.
► Payments are made online by credit card and are completely secure thanks to the Paypal platform. But you don't need to have a Paypal account, you can pay directly on the Paypal platform with your bank card. Paypal is a completely secure online payment service. More information on www.paypal.fr. Upon receipt of your payment, we will process your order. The order validation date corresponds to the online payment date.
►At no time does the customer communicate his banking information to Amélie Pomélo or to a third party.
► The site does not offer the possibility of paying by check, for this method of payment, do not hesitate to contact me via the CONTACT section. If payment by check is agreed between the two parties (Seller and customer), the order will be shipped when the check is cashed.
► An invoice including tax will be provided at the customer's request (VAT not applicable, art 293b of the CGI).

Customs taxes and surcharges
If you live outside the European Union, Amélie Pomélo cannot be held responsible for customs fees or other charges.
4- Delivery and delivery terms
► Delivery times and shipping costs described below and varying depending on the service provider chosen by the customer when ordering. A confirmation email is sent to the customer when their order is shipped. He can access the tracking of his order and the different delivery stages by referring to the La Poste website using his tracking number.
► Delivery times range from 2 to 5 days if the product is available in stock. If the product must be created (order or customization) the seller will indicate the deadline to the buyer by email.
► The seller declines all liability linked to possible delays, theft, loss or damage to the package by La Poste.
► For deliveries in the French Overseas Territories or another country, the delivery terms will be specified to the buyer on a case-by-case basis.
► The buyer wishing to insure the package must specify this when ordering.**
► In the event of non-compliance of a product sold, it may be returned to the seller who will take it back, exchange it or reimburse it.
► The costs for returning the item are the responsibility of the buyer.
► Amélie Pomélo makes every effort to meet delivery times for the products ordered. However, exceeding delivery times cannot give rise to damages, deductions or cancellation of orders.
► However, in the event of non-delivery, due to force majeure, within 30 days of its registration, the customer may cancel his order. (In particular, cases of fire, total or partial strike, accident or failure of the transport provider or a supplier will be considered as force majeure.) In this case, Amélie Pomélo will transfer any payment received to the exclusion of any compensation or damages claimed by the customer.
► In any event, on-time delivery assumes that the customer is up to date with his obligations towards Amélie Pomélo. Amélie Pomélo cannot under any circumstances be held responsible for the consequences of a delivery delay.
► The risk of transport is not borne by Amélie Pomélo. In the event of damaged products, please contact La Poste then Amélie Pomélo
► The buyer is responsible for the shipping costs chosen and therefore applied to their order.
DELIVERY PROBLEM
► The information provided by the buyer when taking the order binds the buyer: in the event of an error in the wording of the recipient's contact details, Amélie Pomélo cannot be held responsible for the impossibility in which she may find herself , to deliver the product.
AT THE DELIVERY
► The customer must check the conformity of the delivered goods at the time of delivery and before signing the receipt from the service provider responsible for delivery. He must indicate on the delivery slip and in the form of handwritten reservations accompanied by his signature any anomaly concerning the delivery.
► This verification is considered to have been carried out once the customer, or a person authorized by them, has signed the receipt.
► If at the time of delivery, the original packaging is damaged, torn or opened, the customer must then check the condition of the items. If they have been damaged, the customer must refuse the package and note a reservation on the delivery slip (package refused because open or damaged).
► From the delivery date indicated in the order form, ownership of the product is transferred to the buyer, except in the case where full payment of the price has not been collected when ordering.
DELIVERY ERROR
► The buyer must make to the seller the same day of delivery or at the latest the first working day following delivery, any claim of delivery error and/or non-conformity of the products in kind or quality in relation to as indicated on the order form. Any complaint made after this deadline will be rejected.

Any complaint not made in accordance with the rules defined above and within the allotted time limits cannot be taken into account and will release the seller from any liability towards the buyer.
In the event of a delivery or exchange error, any product to be exchanged or refunded must be returned to the seller as a whole and in its original packaging, by Colissimo Recommended, to the following person and address:

PRODUCT COMPLIANCE
► If the product does not conform to the order, the buyer must send a complaint to the seller (Amélie Pomélo) with a view to obtaining the replacement of the product or possibly the resolution of the sale within 48 hours after receipt of the order .
5- Right of withdrawal
► In accordance with article L221-18 of the Consumer Code, buyers (non-professional individuals) benefit from a withdrawal period of fourteen days from delivery of their order to return the product to the seller for exchange or refund without penalty, except return costs.
► A 'writing' expressing the desire to withdraw before this deadline must MANDATORY be sent via the contact section of the site.
► Reimbursement will be made by the means of payment identical to the conclusion of the contract, within a maximum of fourteen days upon receipt of the returned goods in their original packaging, complete and in good condition.

► PLEASE NOTE: no withdrawal will be accepted if the returned product is unsuitable for re-marketing. Failing this, the product will be returned to the customer, at their expense.
► Beyond the withdrawal period, any product return, whether for the amicable settlement of a complaint or for any other reason, must be the subject of a formal agreement between the customer and Amélie Pomélo
6- Conditions of returns, refunds or exchanges
► Any request for return, exchange or refund must be made within 14 days after receipt of the order by sending an email to the following address: ameliepomelo@gmail.com or via the contact form.
► Regardless of the withdrawal period mentioned above, you have a period of 14 clear days from the date of receipt of the order to return the item(s) that do not suit you, and subject to compliance with the conditions set out below.
► If we receive your returned items more than 14 working days from receipt of the ordered products, we reserve the right not to exchange or refund the products. The items will be returned to you.
► The return of products must be made in a single package with the products in their original condition, without stains or anomalies. The condition of the products must allow them to be re-marketed in new condition.
► In the event of deterioration of the product (dirt, damage) or missing elements, the seller will have the right to refuse the right of return and refund or exchange. The product will then be returned to the buyer.
7- Protection of Personal Data
► The content of the website remains the property of the seller, the sole owner of the intellectual property rights to this content.
► Buyers undertake not to make any use of this content. Any total or partial reproduction of this content is strictly prohibited and may constitute an offense of counterfeiting.
8- Mediation clause
In the event of a dispute between the Client and the company, they will endeavor to resolve it amicably (the Client will send a written complaint to the professional or, where applicable, to the professional's Customer Relations Department).

9- Intellectual property and counterfeiting
Amélie Pomélo owns the intellectual property rights or holds the usage rights on all elements accessible on the site, in particular texts, images, graphics, logos, icons, sounds, software.
Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited without prior written permission from: Amélie Pomélo
Any unauthorized use of the site or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code.
